HYPRMKT LLC ("we," "us," or "our") operates the HYPRMKT platform at hyprmkt.com and the HYPRMKT mobile applications (collectively, the "Platform"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Platform.
1. Information We Collect
1.1 Information You Provide
- Account information: email address, phone number, username, and password when you register.
- Profile information: profile photo, display name, and bio.
- Listing content: titles, descriptions, photos, videos, pricing, and product attributes you provide when creating listings.
- Showroom content: store name, branding, hero images, about text, and configuration when you create a showroom.
- Messages: content of messages exchanged with other users through our messaging system.
- Payment information: when you subscribe to premium features, payment is processed by Stripe. We do not store your full credit card number.
- Offers and transactions: purchase requests, offers, and delivery preferences.
1.2 Information Collected Automatically
- Device information: device type, operating system, browser type, and unique device identifiers.
- Location data: with your permission, we collect precise GPS location to show nearby listings and verify seller locations. We also use IP-based geolocation for approximate location when GPS is not available.
- Usage data: pages visited, features used, showroom views, listing interactions, search queries, and timestamps.
- Cookies and local storage: language preference, session tokens, and regional settings.
1.3 Information from Third Parties
- Barcode databases: when you scan a product barcode, we may retrieve product information from third-party UPC/EAN databases.
- Vehicle databases: VIN lookups via NHTSA for vehicle listings.
2. How We Use Your Information
- Provide, maintain, and improve the Platform.
- Display your listings and showrooms to other users.
- Enable messaging and offers between buyers and sellers.
- Show relevant nearby listings based on your location.
- Analyze listing photos using AI to generate smart tags for search and discovery (style, materials, era, brand tier).
- Translate showroom and listing content into the viewer's preferred language using AI translation services.
- Detect and prevent fraud, abuse, and security threats (disposable email blocking, geo-fencing, rate limiting).
- Send notifications about messages, offers, bulletins, and account activity.
- Process payments for premium subscriptions.
- Comply with legal obligations.
3. Third-Party Services
We use the following third-party services that may receive your data:
- Amazon Web Services (AWS): media storage (S3), content delivery (CloudFront), and image/video processing (Lambda).
- Google AI (Gemini) and Google Vertex AI: AI-powered listing analysis, smart tag generation, content translation, and image processing.
- Google Geocoding API: forward and reverse geocoding (converting addresses to coordinates and vice versa).
- Stripe: payment processing for premium subscriptions and seller transactions.
- Firebase Cloud Messaging: push notifications on Android and iOS devices.
- Resend: transactional email delivery (account verification, notifications, receipts).
- Sentry: error monitoring and performance tracking to maintain platform reliability.
- Twilio: sends SMS verification codes for account security and authentication; processes phone numbers solely for OTP delivery.
- Cloudflare Turnstile: bot detection and abuse prevention during account registration.
- ipinfo.io: IP-based geolocation for approximate location detection.
- Nominatim (OpenStreetMap): geocoding fallback when the primary geocoding service is unavailable.
- Frankfurter API: currency exchange rates for cross-currency pricing.
- Go-UPC / UPCItemDB: product information lookup from barcode scans.
- CARTO: map tile rendering for location displays.
Each third-party service operates under its own privacy policy. We encourage you to review their policies for information about their data practices.
SMS and Text Message Communications
If you provide a phone number, we may send SMS text messages to verify your account and authenticate sensitive actions. These messages are operational and security-related; we do not send marketing SMS messages.
Message types you may receive:
- Account verification codes during signup or when adding a phone number.
- Sign-in verification codes for HYPRMKT Agent Connect.
Message frequency: SMS is sent only when you initiate an action that requires verification (such as entering your phone number, requesting a sign-in code, or publishing a listing).
Standard message and data rates may apply, depending on your mobile carrier plan.
Your information: No mobile information will be shared with or sold to third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.
Opt-out: You can stop receiving SMS messages at any time by replying STOP to any message we send. You may also remove your phone number from your account in profile settings, which will prevent further SMS sends.

4. Data Sharing
We do not sell your personal information. We may share your information in these circumstances:
- With other users: your listings, showroom content, profile photo, and username are visible to other users. Messages are shared with conversation participants.
- With service providers: as described in Section 3, to operate the Platform.
- For legal compliance: when required by law, regulation, or legal process.
- For safety: to protect the rights, property, or safety of HYPRMKT, our users, or the public.
- Business transfers: in connection with a merger, acquisition, or sale of assets.
The categories above exclude text messaging originator opt-in data and consent: this information is not shared with or sold to any third parties or affiliates.
5. Data Retention
- Account data: retained while your account is active. When you delete your account, we delete your personal data within 30 days, except where retention is required by law.
- Listings and showrooms: deleted when you remove them or delete your account.
- Messages: deleted when both conversation participants delete them or when an account is deleted.
- Media files: photos and videos are deleted from our servers when the associated listing or showroom is deleted.
- Security logs: retained for up to 90 days for fraud detection and abuse prevention.
6. Your Rights
Depending on your jurisdiction, you may have the right to:
- Access your personal data.
- Correct inaccurate data.
- Delete your account and associated data. You can delete your account from Settings > Account > Delete Account.
- Export your data upon request.
- Withdraw consent for location access or notifications at any time through your device settings.
- Object to certain processing of your data.

7. Location Data
Location is central to HYPRMKT's marketplace functionality. We use your location to:
- Show listings near you.
- Verify seller locations are within a reasonable radius of their listed address (geo-fencing).
- Determine your national currency for pricing display.
- Set your default language based on your region.
You can revoke location permissions at any time through your device settings. The Platform will continue to work with reduced functionality (IP-based approximate location).
8. Children's Privacy
HYPRMKT is not intended for users under 13 years of age (or the minimum age in your jurisdiction). We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will delete it promptly.
9. Security
We implement industry-standard security measures including encrypted data transmission (TLS/HTTPS), secure password hashing, session management, rate limiting, and access controls. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.
10. International Data Transfers
HYPRMKT operates globally. Your data may be transferred to and processed in countries other than your own, including the United States, where our cloud infrastructure is hosted. By using the Platform, you consent to these transfers. We ensure appropriate safeguards are in place for international data transfers.
11. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on the Platform with a revised "Last updated" date. Your continued use of the Platform after changes constitutes acceptance of the updated policy.
